These Terms of Service (“Terms”) form a binding agreement between Job4site LLC (“Job4Site,” “we,” “us,” or “our”) and the person or organization that accesses or uses the Job4Site service (“you”). If you use Job4Site for a company, “you” also means that company.
Acceptance, authority, and eligibility
By creating an account, accepting an order or checkout, downloading an application, accessing a customer-facing feature on behalf of a business, or otherwise using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
You must have reached the age of legal majority where you live and be legally capable of entering a contract. If you use the Service for a company, you represent that you are authorized to bind that company. A company order form, written agreement, or purchase-channel term may add to these Terms. If there is a direct conflict, that more specific term controls for the subject it addresses.
Accounts, company owners, and team access
- Provide accurate, current information and keep it updated. Do not impersonate another person or create an account without authority.
- Keep credentials confidential, use reasonable device security, and promptly tell us about suspected unauthorized access. You are responsible for activity performed through your account unless applicable law provides otherwise.
- A company owner or authorized administrator controls invitations, roles, permissions, active status, configuration, and access to the company workspace. The company is responsible for its authorized users and for promptly removing access that is no longer needed.
- Do not share an individual sign-in among multiple people or evade user limits. Each person should use their own authorized account.
If a dispute arises about control of a company workspace, we may pause changes or request documentation reasonably necessary to determine authorized control. We do not resolve ownership, employment, or internal company disputes.
What Job4Site provides
Job4Site provides software for HVAC business operations, which may include customer and equipment records, scheduling, jobs, proposals, package options, invoices, payment records, photos, staff access, service emails, offline capabilities, and optional integrations. Features depend on plan, platform, permissions, location, provider availability, and current product configuration.
Job4Site is a business tool, not professional advice. The Service does not replace HVAC engineering, load calculations, code compliance, permitting, manufacturer instructions, workplace safety, legal, tax, accounting, insurance, or financial advice. Your company remains responsible for its work, pricing, proposals, contracts, disclosures, warranties, permits, taxes, and customer relationships.
Proposal, invoice, numbering, calculation, catalog, and template features are tools for your use. Review all customer-facing records for accuracy before sending or relying on them. You decide what to offer, how to price it, what terms apply to your customer, and whether work is appropriate for a particular property or system.
We may improve, add, modify, or discontinue features. We will provide notice of a material reduction to paid functionality when reasonably practicable or as required by law. We may provide previews, beta features, or examples that are offered as available and may change or end without becoming part of a paid commitment.
Your records remain your responsibility
“Customer Data” means information, records, files, photos, templates, messages, and other content submitted to the Service by or for you. As between you and Job4Site, you retain your rights in Customer Data. You grant us and our service providers a limited, worldwide license to host, copy, transmit, display, transform, and otherwise process Customer Data only as needed to provide, protect, support, and improve the Service, follow your instructions, and comply with law.
You represent and agree that:
- you have the rights, permissions, notices, and lawful basis needed to collect, use, upload, disclose, and instruct us to process Customer Data;
- Customer Data and your use of it will not violate law, contract, privacy, publicity, intellectual-property, consumer-protection, or other rights;
- you will use appropriate care when entering customer information, taking photos, sending communications, and sharing proposal or invoice links; and
- you will respond to requests from your customers and personnel concerning records you control, with our reasonable assistance when required by the Service agreement or applicable law.
Do not upload protected health information, Social Security numbers, full payment-card data, government identification numbers, account passwords, or other information that the Service is not designed to receive. You are responsible for keeping independent copies or exports needed for legal, tax, warranty, operational, or business continuity purposes.
Customer-facing proposal and invoice pages
A recipient may be able to view, select options, accept a proposal, or access an invoice through a shareable link without a Job4Site account. You are responsible for sending links only to intended recipients, including only appropriate information, and treating the links as confidential. An electronic acceptance record is not a guarantee that a contract is enforceable in every jurisdiction; you are responsible for your own customer terms and signature practices.
Trials, billing, renewal, and cancellation
Plan features, user limits, billing interval, price, taxes, trial terms, and any promotional conditions are shown at checkout, in an order form, or through the purchase channel. An offer identified as a subscription continues and renews for the disclosed interval until canceled, unless the checkout or applicable purchase terms say otherwise. By starting a paid subscription, you authorize the applicable payment provider to charge the payment method on file for recurring fees, taxes, and authorized plan changes.
- A trial, when offered, is subject to the eligibility and duration displayed when you enroll. We may limit repeated or abusive trial use.
- Cancel future renewal through the Job4Site billing portal or the store or provider through which you purchased. Cancellation takes effect according to the terms shown by that purchase channel.
- Account deletion and subscription cancellation are separate. If you want both, cancel the subscription through the purchase channel and separately request deletion.
- Refunds and credits, if any, are governed by the checkout, order form, purchase channel, and applicable law. Apple or Google, not Job4Site, controls refunds for purchases they process.
- You are responsible for applicable taxes other than taxes measured by our net income. Keep billing and payment information current.
We may change subscription pricing or plan structure with notice required by law or the applicable purchase channel. Unless you affirmatively agree sooner, a change to recurring pricing applies no earlier than a future renewal date described in the notice.
Third-party services and integrations
The Service may connect with third parties such as Firebase, Apple, Google, Stripe, Intuit QuickBooks, Google Places, and email delivery providers. Third-party services are governed by their own terms, privacy notices, availability, permissions, and fees. They are not under our control, and we are not responsible for their products, acts, omissions, outages, data accuracy, or changes.
When an authorized user connects an integration, you direct us to exchange the data and authorization necessary to perform requested actions. QuickBooks features are a supported handoff, not a promise that every record or field will synchronize automatically. Review information after transfer and maintain the accounting records your business requires. You may disconnect an optional integration, but information previously sent to a third party remains subject to that party’s terms and your account with it.
Use the Service lawfully and responsibly
You may not, and may not help another person to:
- use the Service illegally, deceptively, abusively, or in violation of another person’s rights, consent, or reasonable expectations;
- send spam or unlawful messages; upload malware or harmful code; engage in phishing, harassment, fraud, or unauthorized surveillance;
- access another company’s workspace or records without authority, bypass security or user limits, probe for vulnerabilities, or disrupt the Service or its providers;
- reverse engineer, decompile, disassemble, copy, frame, scrape, or create derivative works from the Service except to the limited extent a restriction is prohibited by law;
- rent, resell, sublicense, or provide the Service as a bureau or competing product unless we agree in writing; or
- remove ownership notices, misrepresent an affiliation, or use the Service to benchmark or train a competing product without written permission.
We may investigate suspected violations and cooperate with lawful requests. Report security concerns privately to support@job4site.com and do not publicly disclose a vulnerability before we have a reasonable opportunity to investigate it.
Job4Site intellectual property
The Service, software, interfaces, design, documentation, trademarks, and related technology are owned by Job4site LLC or its licensors and are protected by intellectual-property laws. Subject to these Terms and payment of applicable fees, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable right to access and use the Service for your internal HVAC business operations during the applicable term.
If you provide suggestions or feedback, you grant us a perpetual, worldwide, royalty-free right to use it without restriction or obligation, provided we do not identify you publicly as the source without permission. No rights are granted except those expressly stated in these Terms.
Suspension, termination, and account deletion
You may stop using the Service and cancel a subscription through the applicable purchase channel. An authorized company owner may request deletion of the company workspace, and an individual may request deletion of their account, by following our account deletion instructions.
We may restrict or suspend access when reasonably necessary to protect the Service or another person, investigate suspected fraud or security issues, respond to legal process, prevent material harm, address nonpayment, or enforce these Terms. We may terminate access for a material or repeated breach, subject to any notice and cure rights required by an order form or applicable law.
When access ends, the license to use the Service ends. Provisions that by their nature should continue—including payment obligations, ownership, confidentiality, disclaimers, liability limits, indemnification, dispute terms, and lawful retention—survive. Company records may remain with the company after an individual user’s access ends. Save or request needed records before closing a workspace; retrieval after deletion may not be possible.
Warranties, liability, and indemnification
Service disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” JOB4SITE DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR THAT DATA OR THIRD-PARTY SERVICES WILL ALWAYS BE AVAILABLE OR ACCURATE. Some jurisdictions do not allow certain disclaimers, so some of these limitations may not apply to you.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOB4SITE AND ITS AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, BUSINESS, GOODWILL, USE, OR DATA, ARISING FROM OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOB4SITE’S LIABILITY WILL BE LIMITED TO THE AMOUNT PERMITTED UNDER APPLICABLE LAW. These limits do not apply where prohibited or to liability that cannot lawfully be limited, including any rights that cannot be waived by agreement.
Indemnification
To the extent permitted by law, you will defend, indemnify, and hold harmless Job4site LLC and its affiliates, officers, directors, employees, and agents from third-party claims, losses, liabilities, damages, judgments, costs, and reasonable legal fees arising from your Customer Data, your HVAC products or services, your customer contracts or communications, your violation of law or these Terms, or your infringement of another person’s rights. This obligation does not apply to the extent a claim results from our own breach of these Terms or unlawful conduct.
Additional Apple and Google terms
If you download the app from Apple’s App Store or Google Play, the store’s usage rules and applicable terms also apply. If these Terms conflict with mandatory store terms, the mandatory store terms control for that conflict. Purchases processed by a store are also subject to that store’s billing, cancellation, and refund processes.
Apple App Store
These Terms are between you and Job4site LLC, not Apple. Job4site LLC, not Apple, is solely responsible for the Job4Site app and its content, maintenance and support, product warranties to the extent not disclaimed, product claims, legal and regulatory compliance, and investigation or defense of third-party intellectual-property claims. Apple has no obligation to furnish maintenance or support. If the app fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price paid to Apple, if any; to the maximum extent permitted by law, Apple has no other warranty obligation.
You represent that you are not located in a country subject to a United States government embargo or designated as supporting terrorism, and you are not listed on a United States government list of prohibited or restricted parties. You must comply with applicable third-party agreement terms when using the app. Apple and its subsidiaries are third-party beneficiaries of this section and, upon your acceptance of these Terms, may enforce it against you. The Apple Standard Licensed Application End User License Agreement applies to the extent required by Apple unless a valid custom license is presented through the App Store.
Google Play
Google is not a party to these Terms and is not responsible for the Job4Site app, its content, or support. Your license to use the Android app is conditioned on compliance with the Google Play terms and applicable usage rules. Google may be a third-party beneficiary only to the extent required by those terms.
General contract terms
Confidentiality
Each party may receive nonpublic business, technical, or financial information identified as confidential or that reasonably should be understood as confidential. The receiving party will use it only for the agreement and protect it with reasonable care. This does not cover information lawfully known without restriction, independently developed, received lawfully from another source, or made public without breach. Lawfully compelled disclosure is permitted with notice when legally allowed.
Governing terms and disputes
The governing-law and forum provisions in an applicable signed order form or written agreement control. If there is no such provision, governing law, jurisdiction, and venue will be determined under the otherwise applicable law, without applying a rule that would defeat mandatory consumer protections. Before filing a formal claim, the parties will attempt in good faith to resolve it by written notice describing the issue and requested resolution, unless emergency or injunctive relief is reasonably necessary.
Changes to these Terms
We may update these Terms to reflect changes in the Service, law, or business practices. We will post the updated Terms with a revised effective date and give additional notice when required. A material change applies prospectively. Continued use after the effective date means acceptance where permitted by law; if you do not agree, stop using the Service and cancel future renewal.
Entire agreement; assignment; waiver; severability
These Terms, the Privacy Policy, applicable order forms, and any incorporated purchase terms are the entire agreement concerning the Service and replace prior discussions on that subject. You may not assign the agreement without our written consent, except where law provides otherwise. We may assign it in connection with a merger, acquisition, reorganization, sale of assets, or by operation of law. A failure to enforce a provision is not a waiver. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions remain in effect. Headings are for convenience, and “including” means “including without limitation.”
Electronic communications
You consent to receive agreements, notices, receipts, and other Service communications electronically. Electronic delivery satisfies a legal writing requirement to the extent permitted by law. Keep your account email current.
